Is Cannabis Oil Legal in South Africa?

The legal status of cannabis in South Africa changed fundamentally in September 2018, when the Constitutional Court handed down a landmark ruling.

The 2018 Constitutional Court Ruling

In the case of Minister of Justice and Constitutional Development v Prince, the Constitutional Court ruled that the personal use, possession, and cultivation of cannabis by adults in private spaces is legal in South Africa. Criminalising private cannabis use was ruled an unjustifiable infringement of the constitutional right to privacy.

This ruling effectively decriminalised cannabis for personal use across the country.

What Does This Mean for Cannabis Oil?

Cannabis oil falls within the scope of cannabis for personal use. Adults may legally possess cannabis oil for personal use, use cannabis oil in private, and have cannabis oil delivered to their home.

Regulation of CBD Products

In 2019, SAHPRA (South African Health Products Regulatory Authority) updated its regulations to allow the sale of complementary and health products containing CBD (cannabidiol) in concentrations up to 20mg per daily dose without a prescription.
